Mayor Bodker: Why He's Not Turning Over Records

"When your personal rights are being trampled then I think you have to take a stand," said the Johns Creek mayor.

Over the summer the Johns Creek City Council launched an investigation against the mayor for possible wrong-doing. 

And last Thursday, Sept. 19, the Johns Creek City Council held a Special Called Meeting that resulted in resolution to subpoena Mayor Mike Bodker for records they say are necessary to their investigation.


Bodker has steadfastly refused to turn over his personal records which he says are just that, personal.

"I've taken a principled stand," said Bodker "When your personal rights are being trampled then I think you have to take a stand."

Among the information the investigating attorney is demanding is that all his cell phone records dating back to 2007, for both his city-issued phone and his personal phone, be turned over. And the investigator wants copies of lease agreements on certain properties owned by the mayor.

But Bodker says that the attorney has never explained why those records are needed and says he's unwilling to turn over his personal records carte blanche without knowing what they are looking for.

"If I allow it to occur now (hand over his personal records), when will it end?" asked Bodker.

Bodker, who has been the city's mayor since its founding in 2006, points to the possibility that this investigation is politically motivated. He knows of no other reason because he he says he's never seen any charges.

Correspondence has gone back and forth between attorneys but Bodker said there's been no explanation on why they want his phone records and copies of his leases. 

"There's a principal here," he said. "That's why I'm doing what I'm doing. This is intensely personal. They don't have any evidence that I did anything wrong."
